Truck Crash: Tractor Trailer Kills Woman
Bowie County, Texas—On December 22, 2005, a tractor/trailer rig, driven by Kevin Dale Hickey and owned by Lakewood Contracting, L.L.C., crossed the center line of traffic and collided with Mary Like Lindsey’s vehicle, killing her passenger, Thelma M. Davis Betts.
Wigington Rumley Dunn & Blair LLP filed a suit contending that defendant Kevin Dale Hickey was negligent in this incident, and such negligence was a proximate cause of the death of Mrs. Betts and the damages suffered by the plaintiffs. Additionally, they alleged Mr. Hickey’s employer, Lakewood Contracting, L.L.C, was vicarious responsible for the negligence of Mr. Hickey based on the theory of Respondeat Superior.
Mrs. Betts’ husband, Albert Joe Betts, and her four adult children each sought to recover damages for the grief, mental anguish, emotional pain, torment and suffering they experienced, as well as loss of companionship, and loss of care, maintenance, support, services, advice, and counsel. This case settled for a confidential sum.
