Recalls

Recalls involve a procedure overseen by the federal government where a dangerous product is removed from sale and a warning is issued to the general public of the danger, usually with instructions on how to return or repair the good.

Sometimes, the recall is issued by the company responsible for making it (the manufacturer) on a voluntary basis. Distributors and retailers (stores) occasionally issue recalls, too. These are “voluntary recalls.”

Deadly Products and Government Recalls

However, some of the most dangerous and deadly goods are not recalled by those responsible for sending them out into the marketplace and exposing innocent victims to harm or death. In a shocking number of cases, the dangerous product has killed and caused the death of many victims before the federal government intervenes and issues an official recall of the item.

Many of these official government recalls of deadly products come from agencies including:

  • Consumer Product Safety Commission (CPSC);
  • Food and Drug Administration (FDA);
  • National Highway Traffic Safety Administration (NHTSA).

For instance, you can search your vehicle identification number (VIN) at the NHTSA web site to check on any current recalls applicable to your car, truck, or SUV.

Aggressive Defective Product Lawyers

Every day, consumers throughout Texas and the rest of the United States are using potentially dangerous or deadly products. Sometimes, these are known dangers. Recalls have been issued. Sadly, today there are so many recalls made for consumer goods in this country that no one can be sure everything they own or use is safe.

More and more, there are products released into the marketplace where manufacturers and distributors are aware they are defective or dangerous, but for their own gain, they delay issuing a warning or recall.

When you or a loved one has been injured by a product that was recalled before your accident occurred or afterwards, there is the possibility that you have significant legal claims to assert against a variety of parties who share responsibility for allowing that recalled, defective product to be sold.

Product liability laws exist to protect victims against products that have been improperly or illegally designed, manufactured, distributed, or sold.
