Defective Design: Nissan Rollover Causes Death
Nueces County, Texas: On or about February 1, 2004, Debbie Gonzalez lost control of her 2002 Nissan Xterra and the vehicle rolled over on the roadway. The passenger, Gabriel A. Buentello was ejected, causing serious injuries, which led to his eventual death.
Wigington Rumley Dunn & Blair LLP filed a suit contending that the vehicle in question was unreasonably dangerous due to its poor handling, stability and propensity to rollover, as well as having a defective safety restraint system, since it failed to utilize laminated glass in the side windows.
Gabriel A. Buentello’s estate sought to recover for his mental anguish, physical pain, and necessary funeral bills and expenses. His parents, Oscar and Alma Buentello sought damages for the loss of companionship, loss of consortium, and loss of inheritance, including pecuniary damages and mental anguish. This case settled for a confidential sum.
