Defective Car Part: Tire Defect Causes Rollover
Michoacán, Mexico: On or about March 2, 2010, plaintiffs Martin Balderas Almazo, Elizabeth Briz Lopez and Martin Gabriel Balderas Briz, minor child, were traveling in their vehicle when the right rear tire de-treaded, causing the driver to lose control and roll several times. It is believed that the right rear subject tire, manufactured and/or distributed by Cooper Tire, suffered a tread-belt separation and failure, which resulted from the defective design and manufacture of the subject tire.
Wigington Rumley Dunn & Blair, L.L.P. filed suit contending that Cooper Tire was negligent in designing, manufacturing and marketing the tire, which failed and was involved in this accident. Such negligence proximately caused the injuries and damages to the plaintiffs. This case settled for a confidential sum.
