Defective Car Design: Fender Bender Causes Death
El Paso County, Texas: On November 16, 2007, a Ram Pickup rear-ended a 2000 Ford Explorer, driven by John D’errico and occupied by Emiliano Rocha. The vehicle went out of control and rolled over, causing both occupants to be ejected. Although properly restrained at the time of the accident, due to the Ford Explorer’s poorly designed restraint system, both occupants suffered catastrophic injuries, resulting in their death.
Wigington Rumley Dunn & Blair LLP filed a suit contending that the 2000 Ford Explorer was defective, unfit and unreasonably dangerous due to its poorly designed restraint system. As a direct result of the defective nature of the Ford Explorer, John D’errico suffered severe injuries, which led to his eventual death. This case settled for a confidential sum.
