Commercial Driver Causes Serious Accident

Maverick County, Texas: On August 13, 2014, Alfredo Escobedo was late to his next DirecTV appointment and ran a stop sign colliding into Thomas Sanchez and his son. Mr. Sanchez underwent multiple-level back fusion surgeries. While the surgery was a success, Thomas Sanchez continues to suffer and likely will have continued treatment and care for the rest of his life. He was earning a good wage as a tire inspection technician but could no longer lift the heavy tires due to the injuries from the motor vehicle collision.

Cullen Moore and David Rumley of Wigington Rumley Dunn & Blair, LLP prosecuted a lawsuit against MasTec North America, Inc., AT&T, DirecTV, and the driver of their van. Records obtained from the defendants demonstrated an ability to monitor the driving habits of their driver Escobedo, but a lack of any effort to actually monitor him. In fact, a defendant’s representative testified that had they known of the driving records from just a two-month period of time that was prior to the collision, MR. Escobedo would not have been driving that company vehicle on the day of the collision with Mr. Sanchez and his son.

Mr. Sanchez suffered severe, permanent, and disabling injuries as the result of Mr. Escobedo’s failure to obey traffic laws and reasonable driving practices and due to his company’s failure to monitor and enforce proper driving behaviors. He sought to recover damages for the medical expenses both past and future, physical impairment, disfigurement and the physical pain and mental anguish he suffered in this traumatic collision. This case settled for a confidential sum.
