18 Wheeler Pins and Crushes Man Between Two Vehicles
Bexar County, Texas: On May 27, 2017, a retired United States Army Colonel was pinned and crushed between two parked vehicles in a Walmart parking lot when an 18-wheeler truck driver blindly reversed his trailer into the vehicles. The Colonel’s children witnessed their father being crushed and were able to stop the 18-wheeler driver from continuing to power his trailer into the parked vehicles. Unfortunately, their father still suffered catastrophic injuries.
Wigington Rumley Dunn & Blair, LLP filed suit on behalf of the Colonel and his family contending that the negligence and gross negligence of the truck driver and the trucking company were the cause of their injuries. Through the course of their investigation, Wigington Rumley Dunn & Blair, LLP uncovered evidence which showed that the 18-wheeler driver was fatigued at the time of the accident and had falsified multiple records to avoid compliance with the Federal Motor Carrier Safety Regulations (FMCSRs). Wigington Rumley Dunn & Blair, LLP also developed evidence that the trucking company knew its 18-wheeler driver had been habitually violating the Federal Motor Carrier Safety Regulations. This case settled for a confidential sum.
